Kṛṣṇacandra Dāsa – Vṛndāvan: If one was to imagine how our ISKCON society would operate had it not been hijacked and subsequently sabotaged by devotees with ulterior agendas and self interest – one could imagine it based it on Śrīla Prabhupāda’s Will, which is of course the legal / righteous / proper and chaste thing to do. The ISKCON that Śrīla Prabhupāda established would be an entirely different organization / society than the one that the GBC have morphed it into today. Below is a critical analysis of Śrīla Prabhupāda’s will to display how much the GBC and Rubberstamped Gurus have altered the movement, over the last three decades, turning it into exactly what Śrīla Prabhupāda warned us not to do.

DECLARATION OF WILL

I, A.C. Bhaktivedanta Swami Prabhupāda, founder-ācārya of the International Society for Krishna consciousness, Settlor of the Bhaktivedanta Book Trust, and disciple of Oṁ Viṣṇupāda 108 Śrī Śrīmad Bhaktisiddhānta Sarasvatī Gosvāmī Mahārāja Prabhupāda, presently residing at Śrī Kṛṣṇa-Balarāma Mandir in Vṛndāvana, make this my last will:

1. The Governing Body Commission (GBC) will be the ultimate managing authority of the entire International Society for Krishna Consciousness.

 

Although Śrīla Prabhupāda, as the Founder Ācārya of ISKCON, instructed the GBC to be the ultimate managing authority of his ISKCON Society, he did not give licence to the GBC members to change anything as they saw fit.

He has given his mandates and instructions on the aims and objectives, rules and regulations, roles and functions within the institution that he built up from the grassroots with his hard work and dedication when serving both his Spiritual Master, Śrīla Bhaktisiddhānta Saraswati Mahārāja, and Lord Śrī Kṛṣṇa. It is the GBC’s only duty to serve Śrīla Prabhupāda and the entire society of Vaiṣṇavas by strictly following the instructions and teachings of His Divine Grace AC Bhaktivedanta Swami Śrīla Prabhupāda by simply managing Śrīla Prabhupāda’s movement.

The GBC ignored Śrīla Prabhupāda’s methods and converted ISKCON into a Formula Franchise Business.

This is very important to understand. In Śrīla Prabhupāda’s ISKCON there was Śrīla Prabhupāda and under him as managers were the GBC and under them were the Executive Directors and under them the Temple Presidents with regards to the management of ISKCON. These were all operating under Śrīla Prabhupāda’s Direction of Management program.

What occurred after Śrīla Prabhupāda’s departure was that his system was made defunct and the original ṛtvik representatives of the Ācārya (ORROTA) immediately converted Śrīla Prabhupāda’s system into what is known in the corporate world as a ‘Formula Franchise’ system where they gifted each other Formula Franchises to privately operate under the trade name of ISKCON.

No longer was Śrīla Prabhupāda the spiritual and managerial authority under which the GBC functioned. Now the formula franchises were autonomous entities each operating under the ‘umbrella or parent’ corporate body known as ISKCON. Each was given the figurehead title of Guru and was given the authority to recruit their own employees and volunteers and the right to procure their own funds/donations however they deem fit.

As Formula Franchises they gave some profit for the skeletal running of the parent body – the GBC; while they hoarded their profits siphoning them off into private ISKCON Bank Accounts or Not For Profit Companies and the various Charitable Trusts that they formed.

2. Each temple will be an ISKCON property and will be managed by three executive directors. The system of management will continue as it is now and there is no need of any change.

Here it clearly states that each ISKCON property shall be managed by three [3] Executive Directors. Śrīla Prabhupāda goes on to state that “there is no need of any change.”

Where does this system exist in ISKCON today? Which Temple, Farming Community or Project is managed by three Executive Directors?

3. Properties in India will be managed by the following executive directors:

a) Properties at Śrī Māyāpur Dhāma, Panihati, Haridaspur and Calcutta: Gurukṛpā Swami, Jayapatākā Swami, Bhavānanda Gosvāmī and Gopal Kṛṣṇa das Adhikārī.

b) Properties at Vṛndāvana: Gurukṛpā Swami, Akshoyananda Swami, and Gopal Kṛṣṇa das Adhikārī.

c) Properties at Bombay: Tamāla Kṛṣṇa Gosvāmī, Giriraj das Brahmachary, and Gopal Kṛṣṇa das Adhikārī.

d) Properties at Bhubaneswar: Gour Govinda Swami, Jayapatākā Swami, and Bhagawat das Brahmachary .

e) Properties at Hyderbad: Mahāṁśa Swami, Śrīdhar Swami, Gopal Kṛṣṇa das Adhikārī and Bali Mardan das Adhikārī.

The executive directors who have herein been designated are appointed for life. In the event of death or failure to act for any reason of any of the said directors, a successor director or directors may be appointed by the remaining directors, provided the new director is my initiated disciple following strictly all the rules and regulations of the International Society for Krishna Consciousness as detailed in my books, and provided that there are never less than three (3) or more than five (5) executive directors acting at one time.

The Executive Directors are life time positions which give continuity of management which is very important for the growth and development of any community. However that does not mean that they are so permanent that even if they become debauched rascals that the community has to put up with them forever.

There is a very important clause in Śrīla Prabhupāda’s will regarding these positions. The “failure to act for any reason” clause means that should an Executive Director fail to act they can be removed. Now this ‘failure to act’ is an interesting clause. This means that Śrīla Prabhupāda mandated that an official member is not a “do as you please” position. It means that you have been given a duty and therefore you have a duty to comply with the requisites of the duty. If, however, you fail to act to properly discharge your given duty then you can be removed and replaced. Please remember it is a failure to act for any reason clause…

‘Failure to act’ may be broken down into several aspects and or charges against the party or parties who were given the said duty.

  1. Nonfeasance is to ignore and take no indicated action – neglect or A ‘failure to act’ when under an obligation to do so; a refusal (without sufficient excuse) to do that which it is your legal duty to do.
  1. Misfeasance is to take inappropriate action or give intentionally incorrect advice.
  1. Malfeasance is hostile, aggressive action taken to injure the client’s interests.

The ‘failure to act’ ‘clause has to be considered as ‘nonfeasance’ when understanding the gross dereliction of duty that the GBC, Rubberstamped Guru and Temple Authorities have committed in their duty to comply with the instructions of His Divine Grace AC Bhaktivedanta Swami Śrīla Prabhupāda when managing his Society. It must also be seen to be ‘misfeasance’ when they lied to their God Brothers and Sisters regarding their status as gurus and as ‘malfeasance’ in the hostile and aggressive way in which they ruthlessly and viciously imposed their dictatorial/fascist rule on their God Brothers and Sisters forcing them to either bend their knees in supplication or leave ISKCON.

One day perhaps the above ‘failure to act’ clause of Śrīla Prabhupāda’s Will, will be taken seriously by senior men and women of our Society and these devotees who have behaved in such a manner that can only be described as sabotage, will be brought to justice by facing the Judicial system for their breach of contract / ‘failure to act’ in their official capacity as executors/managing directors etc of Śrīla Prabhupāda’s ISKCON – while still in their offensively corrupt bodies.

4. I have created, developed and organized the International Society for Krishna Consiousness, and as such I hereby will that none of the immovable properties standing in the name of ISKCON in India shall ever be mortgaged, borrowed against, sold, transferred, or in any way encumbered, disposed of, or alienated. This direction is irrevocable.

5. Properties outside of India in principle should never be mortgaged, borrowed against, sold, transferred or in any way encumbered, disposed of, or alienated, but if the need arises, they may be mortgaged, borrowed against, sold, etc., “with the consent of the GBC committee members associated with the particular property.

6. The properties outside of India and their associated GBC committee members are as follows:

a) Properties in Chicago, Detroit and Ann Arbor: Jayatīrtha das Adhikārī, Harikeśa Swami, and Balavanta das Adhikārī

b) Properties in Hawaii, Tokyo, Hong Kong: Guru Kṛpā Swami, Rāmeśvara Swami and Tamal Krishna Gosvāmī.

c) Properties in Melbourne, Sydney, Australia Farm,: Guru Kṛpā Swami, Hari Śauri, and Ātreya Ṛṣi.

d) Properties in England (London Radlett), France, Germany, Netherlands, Switzerland and Sweden: Jayatīrtha das Adhikārī, Bhagavān das Adhikārī, Harikeśa Swami.

d) Properties in Kenya, Mauritius, South Africa: Jayatīrtha das Adhikārī, Brahmānanda Swami and Ātreya Ṛṣi

e) Properties in Mexico, Venezuala, Brazil, Costa Rica, Peru, Ecquador, Colombia, Chile: Hṛdayānanda Gosvāmī, Pañca Draviḍa Swami, Brahmanananda Swami.

t) Properties in Georgetown, Guyana, Santo Domingo, St. Augustine: Adi Keśava Swami, Hṛdayānanda Gosvāmī, Pañca Draviḍa Swami.

g) Properties in Vanouver, Seattle, Berkeley, Dallas: Satsvarūpa Gosvāmī, Jagadīśa das Adhikārī, Jayatīrtha das Adhikārī.

h) Properties in Los Angeles, Denver, San Diego, Laguna Beach: Rameswara Swami, Satsvarūpa Swami, Adi Keśava Swami.

i) Properties in New York, Boston, Puerto Rio, Port Royal, St. Louis, St Louis Farm: Tarnal Krishna Gosvāmī, Adi Keśava Swami, Rameswara Swami.

j) Properties in Iran: Ātreya Ṛṣi, Bhagavān das Adhikārī, Brahmanananda Swami.

k) Properties in Washington D.C., Baltimore, Philadelphia, Montreal and Ottawa : Rūpānuga das Adhikārī, Gopal Krishna das Adhikārī, Jagadīśa das Adhikārī.

I) Properties in Pittsburg, New Vṛndāvana, Toronto, Cleveland, Buffalo: Kīrtanānanda Swami, Ātreya Ṛṣi, Balavanta das Adhikārī.

m) Properties in Atlanta, Tennessee Farm, Gainsville, Miami, New Orleans, Mississippi Farm, Houston: Balavanta das Adhikārī, Adi Keśava Swami, (Rūpānuga das Adhikārī.

n) Properties in Fiji: Hari Śauri, Ātreya Ṛṣi, Vasudev.

7. I declare, say and confirm that all the properties, both moveable and immovable, which stand in my name, including current accounts, savings accounts and fixed deposits in various banks, are the properties and assets of the International Society for Krishna Consciousness, and the heirs and successors of my previous life, or anyone claiming through them, have no right, claim or interest in these properties whatsoever, save and except as provided hereafter.

8. Although the money which is in my personal name in different banks is being spent for ISKCON and belongs to ISKCON, I have kept a few deposits specifically marked for allocating a monthly allowance of Rs. 1,000/- each to the members of my former family, (two sons, two daughters, and a wife). After the death of the members of my former family, these specific deposits (corpus, interest, and savings) will become the property of ISKCON for the corpus of the trust, and the descendants of my former family or anybody claiming through them shall not be allowed any further allowance.

9. I hereby appoint

Guru Kṛpā Swami,

Hṛdayānanda Gosvāmī,

Tamal Krishna Gosvāmī,

Rameswara Swami,

Gopal Kṛṣṇa das Adhikārī,

Jayatīrtha das Adhikārī and

Giriraj das Brahmachary

to act as executors of this will. I have made this will this 4th day of June, 1977, in possession of full senses and sound mind, without any persuasion, force or compulsion from anybody.

All of the above mentioned disciples and executors of Śrīla Prabhupāda’s will; failed, cheated and sabotaged his Society and are all to be held responsible for this gross dereliction of their duty to honour, serve and glorify the pure devotee of the Lord His Divine Grace AC Bhaktivedanta Swami Śrīla Prabhupāda.

These seven devotees were given, by Śrīla Prabhupāda, a most treasured and vital responsibility, Śrīla Prabhupāda loved and trusted them with his life and his work and his mission and they all, every single last one of them, failed him. They did not only fail him, they failed us all.

Five of these devotees are still alive and three and a half (Hrydayananda) of them are active devotees in ISKCON. These devotees are all reaching old age and the duty and responsibility is on them to comply with Śrīla Prabhupāda’s direct and lucid instructions and rectify the situation as executors of his will.

Gopal Kṛṣṇa Goswami, Giriraja Swami and Hydayananda Goswami are all so called senior men who have tremendous power, influence and therefore responsibility within the ISKCON society. They are now to be held responsible for the wrongs of the movement and for not only what they helped to sabotage but for their cowardly behaviour in not speaking up for His Divine Grace AC Bhaktivedanta Swami Śrīla Prabhupāda and protecting his legacy, ISKCON, and his disciples, both present and future.

They are also held responsible for their selfish greedy grab for the role, property, resources and disciples which were meant for Śrīla Prabhupāda.

If, for the last three decades, they had done their duty to serve their so called spiritual master in the manner that he had prescribed and entrusted them to do, then our Society would be a vastly different society. It was and is their duty as officials of ISKCON to enact their duty with regards to Śrīla Prabhupāda and not to selfishly extract whatever they can from His Divine Grace AC Bhaktivedanta Swami Śrīla Prabhupāda’s movement.

The above devotees in particular and all the successive reprobates who have greedily taken roles, positions, disciples, resources and property belonging to Śrīla Prabhupāda will eventually have to face:

  1. Judgement by their peers and seniors in our ISKCON Society or
  2. Face legal implications for their ‘failure to act’ to comply with Śrīla Prabhupāda’s orders and instructions
  3. Face Śrīla Prabhupāda at the end of their miserable cheating lives
  4. Face Yamaraja for their cheating ways
  5. Face the Supreme Personality of Godhead for committing Guru / Vaiṣṇava aparādha against His Divine Grace AC Bhaktivedanta Swami Śrīla Prabhupāda and his sincere loyal disciples.

 

Conclusion:

ISKCON, under the reign of the Formula Franchised Guru system and their Managerial counterparts, the GBC, has effectively morphed Śrīla Prabhupāda’s ISKCON into a system based on business and financial incentive. The managerial system that they have established removes the lines of authority and managerial structure that Śrīla Prabhupāda established in order for his Society to be managed while maintaining his preeminent position within the Society he founded.

Śrīla Prabhupāda’s system was based on permanence and community development. That is why he;

1. Established Himself as the permanent and supreme authority in all matters of his society

2. Trained and instructed the GBC to make sure that this structure was maintained and managed in accord with his instructions orders and teachings under his management system outlined in the Direction of Management DOM

3. Willed that there were three permanent Executive Directors to oversee his Temples Farms and Projects which we appointed from the GBC body

4. Had his Temples and other Centres managed by local Temples Presidents who;

a. Were elected from and by the devotional communities

b. Trained up bhaktas and devotees to take spiritual dīkṣā from His Divine Grace AC Bhaktivedanta Swami Śrīla Prabhupāda

c. Submitted the names of a candidate to the ṛtvik representatives of the Ācārya [RROTA]

and arrange the initiation ceremony to be performed by a ṛtvik priest etc as per Śrīla Prabhupāda directions in the July 9th Document

d. Maintain Deity worship and organise Saṅkīrtana parties to distribute Śrīla Prabhupāda books

e. Collect donations and funds to use for the growth and development of their Temples or projects

 

This was ‘in a nutshell’ the system that he established and so it was the formula he prescribed for his ISKCON Society. There is no room in this system for independent guru franchises that use his Temples, Projects and bank accounts to establish and develop their own private guru franchises independent of the parent body ISKCON.

When Śrīla Prabhupāda was the centre it meant that all monies collected were centrally controlled and placed in specific funds for specific purposes meant to grow and develop our Vaiṣṇava Society globally, under the strict guidelines established by Śrīla Prabhupāda. However now that there are over 90 independent guru franchises operating in ISKCON it is not possible to monitor and control the monies as it is in the hands of the private formula guru franchises that dispense with it according to their desire and the GBC itself or in other words the parent corporation of ISKCON, is left poor.

The annual budget for the International GBC for 2011 is US 86,000 dollars. So one would have to ask – where do the millions of dollars in donations go? The GBC is the ultimate managing authority yet how much managing does it do with the millions of dollars that the formula franchised gurus collect? An annual budget for such a large international society is only $86,000US which is probably what the UK Manor makes in a week from donations and yet the GBC is so poorly funded.

The Franchise Gurus are only obligated to give a financial account of their business on a yearly basis but how is this monitored and are the gurus audited? These Gurus like Radhanatha, Indradyumna Swami etc have their own non ISKCON businesses and projects which are obviously not accounted for by the GBC. So what is their gross worth per year? How many millions of dollars are generated from the major centres in India and throughout the world? What happens to this money? These Gurus are not poor they are, in many instances, multi millionaires yet ISKCON itself only has a budget of US $86,000, that is eighty six thousand dollars?!?!

Śrīla Prabhupāda wanted that every single last rupee was accounted for. What is the financial status of our ISKCON society taking into consideration all Temples, projects and properties and what is the status of the guru franchises? Compare this to the annual GBC budget and you will see why Śrīla Prabhupāda wanted this controlled.

This is just some of the resultant factors of the GBC members’ “failure to act” in accordance to their duty as prescribed in His Divine Grace AC Bhaktivedanta Swami Śrīla Prabhupāda’s last will and testament.

What more do you need to know in order to stand up and be counted as a Śrīla Prabhupāda loyalist? How long will you read and read stuff without saying a word in protest? Above is our spiritual master’s last will and testament and these reprobates have completely and utterly ignored his will. This is Guru / Vaiṣṇava aparādha and hardly a soul says a word?
